Terms of Service

These Terms of Service ("Terms") govern your use of eonicnewyork.com and any services offered by EONIC ("we," "us," or "our"), including our SMS messaging program. By using the Site, placing an order, or opting in to messages, you agree to these Terms. If you do not agree, do not use the Site or the program.

You must be at least 13 years old to use the Site, and at least 18 to make a purchase. By opting in to SMS, you represent that you are the subscriber or authorized account holder of the mobile number you provide.

• All orders are subject to acceptance and availability. We may refuse or cancel any order at our discretion.
• Prices, taxes, and shipping are shown at checkout and may change without notice.
• Payments are processed by third-party processors (e.g., Shopify/Stripe). You authorize the charges shown at checkout.

The following terms govern the EONIC SMS program and are required for A2P 10DLC compliance.

• Consent. By submitting your phone number to EONIC(on our website, at checkout, by SMS keyword, or at an event), you agree to receive recurring automated marketing and transactional text messages from EONIC at the number provided, including messages sent using an automatic telephone dialing system. Consent is not a condition of any purchase.
• Program description. Messages may include promotions, product launches, early-access alerts, drop reminders, abandoned-cart reminders, order and shipping updates, and customer service replies.
• Message frequency. Message frequency varies (typically 4–10 messages per month; more during launches or order activity).
• Cost. Message and data rates may apply. EONICdoes not charge for messages; your wireless carrier may.
• Opt-out. Reply STOP to any message to opt out. You will receive a single confirmation message.
• Help. Reply HELP for help, or email support@eonicnewyork.com.
• Supported carriers. Carriers are not liable for delayed or undelivered messages. Availability may vary by carrier.
• Privacy. We do not sell or share mobile numbers or SMS opt-in data with third parties for their own marketing. See our Privacy Policy for full details.
• Changes. We may modify or terminate the SMS program at any time, with notice where required by law.

Shipping times and return windows are described on our shipping and returns pages. Items must be returned in original, unworn condition with tags attached unless otherwise stated. Final-sale items are not eligible for return.

The Site, including its design, text, graphics, photography, logos, and the EONIC name, is owned by EONIC and protected by U.S. and international intellectual-property laws. You may not use any of it without our prior written permission.

You agree not to use the Site to violate any law, infringe any right, transmit malicious code, scrape or harvest data without permission, or interfere with the Site's operation.

The Site and the SMS program are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, EONIC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, products, or SMS program. Our total liability for any claim will not exceed the amount you paid EONIC in the 12 months preceding the claim.

You agree to defend, indemnify, and hold EONIC harmless from any claim or demand arising from your breach of these Terms or your violation of any law or the rights of a third party.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in New York County, New York.

We may update these Terms from time to time. The revised Terms will be posted on this page with a new "Last Updated" date. Continued use of the Site after changes constitutes acceptance.
